Are pledges legally enforceable? What terms should a pledge
agreement contain? What should you do if a donor wants to
describe a donation as a contract? And what about this new IRA
Rollover provision? Jack Siegel will explore these questions and
more during the next AFP Audio
Conference on Nov. 1, 2006.
Legal issues aren’t always the most exciting
subjects that fundraisers get to discuss, yet they have to
address such issues all the time in their work. In his Nov. 1
Audio
Conference, “Fundraising With a Long-Term Perspective:
The Legal Aspects,” Siegel will focus on topics that are
relevant and important for fundraisers to know. This isn’t a
session for lawyers, but for fundraisers who need to have a
working understanding of issues such as donor control, pledges
and restricted gifts.
Siegel will use a variety of real-world
examples, such as the recent experiences of Princeton
University, St. Mary's College, Florida State University, Sophie
Newcomb College, Hershey Trust, Metropolitan Opera and the New
York Historical Society, to name a few.
Siegel will then turn to the tax changes
under the Pension Protection Act, a name that is extremely
misleading in terms of the law’s significant impact on charities
and fundraisers. He will focus on new reporting requirements for
contributions of money, limitations on gifts of art works to
museums, limitations on gifts of personal property (clothing and
household goods) to charities, the new provision removing
impediments to gifts of IRA distributions to charities, new Form
990T disclosure requirements, and a number of other provisions
directly relevant to fundraising.
Siegel provides training and consulting
services to nonprofits through Charity Governance Consulting
LLC. He is a lawyer and a CPA, and writes the
Charity Governance Blog. He holds a Masters in Management
from Northwestern University’s Kellogg Graduate School of
Business and wrote A Desktop Guide for Nonprofit Directors,
Officers, and Advisors: Avoiding Trouble While Doing Good
(John Wiley 2006), a comprehensive guide to the legal,
financial, tax and regulatory issues facing charitable
organizations.
Target Audience:
This program contains U.S. legal content. The presentation will
be most meaningful to those with several years of experience in
the area of fundraising. However, anyone engaged in fundraising
must understand these issues so there is no time like the
present for beginners to delve into this topic. There is nothing
magic or mysterious about the law, particularly since the
presentation will be based on actual events and assumes no legal
knowledge.

- Be able to identify some of the tax issues associated with
gifts
